These Conditions will apply between you and Stromberg Carburetor, when you buy an item from stromberg-97.com. The Conditions do not affect the rights you may have under any relevant statutory law.
 
Your contract for purchases made through stromberg-97.com is with Phobix Ltd, dba Stromberg Carburetor.

All the items we sell are new. Every care has been taken to describe and portray items accurately using current technology, but slight variations (eg, in colour shades) in actual goods may occur. Please be aware that colour variations may also occur due to the differences in representation on computer screens. All carburetors and associated mechanical products are covered by a 12-month guarantee subject to these Conditions and our Limited Warranty, also detailed on this website. Stromberg Carburetor warrants clothing products to be free of defects in materials and workmanship at the time of purchase as detailed in our Limited Warranty statement.
 
Ordering
Genuine Stromberg products are available from a network of Genuine Stromberg dealers in many countries around the world. To place an order direct with Stromberg Carburetor, dealers should phone, write, fax or email us (sales@stromberg-97.com), stating the following information: 1) your name; 2) your Dealer Code (if applicable); 3) your purchase order (if applicable); (4) the exact part number(s) required; (5) the quantities ordered; and (6) your shipping instructions.
 
Genuine Stromberg dealers can also order online on this website via our dealer shop. Stromberg Clothing & Collectibles products can also be purchased online by the general public direct from this website.
 
Every order will be confirmed before picking and dispatch. Once ready to ship, we will email you detailing the order, prices and shipping costs.
 
When placing an order, you agree that any and all information given is accurate and complete. All orders are subject to acceptance by us and product availability. Wherever possible, we will attempt to combine multiple orders in one shipment.
 
We reserve the right to make changes in our merchandise without notice. Availability information for products is listed on each individual product description. An item may be out of stock temporarily or permanently, or discontinued from our product line. When an item is no longer available, we take reasonable steps to remove it from the website as soon as we can. If you cannot find an item you saw on a previous visit, please notify us and we will let you know whether we can find the item for you. If stromberg-97.com does not have stock to deliver the goods you have ordered, we will not charge your credit or debit card until the items are back in stock and ready to be shipped.

No contract for the sale of any product will exist between you and stromberg-97.com until we accept your order by shipping the product to you. The price of any item is not guaranteed until the item has been shipped to you. When this happens, we will confirm our acceptance of your order by sending you an email. If the price of a product you have ordered should change prior to shipment, you will be notified by email that your order has not been accepted by us and will not ship. You may re-order the item at the adjusted price if you wish.
 
This confirmation email will be sent to the email address given on your order form and will detail products ordered, payment method, cost (including sales tax and Shipping & Handling) and usual delivery times.
 
You must check that all the details on this confirmation email are correct and contact us as soon as possible if any details are incorrect. If your order has not been accepted, you will receive an explanatory email from us detailing the reasons why.
 
Back Orders
We try to avoid back-orders, but occasionally this is unavoidable. If an item will be restocked at the warehouse within a reasonable time (two to three days), we may delay your shipment so we can fulfil it in full. If, for any reason, there is a delay in fulfilling part of your order, back-ordered items will be noted on the invoice and delivery note. We will not send substitutes.
 
Back-ordered items will not be billed until such time as they become available, and shipped as soon as possible. You will not be charged shipping for back-ordered items shipped alone. However, Stromberg Carburetor may elect to include back-ordered items with future new order shipments if timing coincides.
 
If an item is no longer available, we will remove it from the website as soon as possible. In the unlikely event that you have already ordered it, we’ll let you know.

While we aim to provide comprehensive manufacturer support via phone and email, we recommend you first contact your nearest Genuine Stromberg dealer, who can assist with technical queries, recommend and sell you the correct products you need.

Payment
stromberg-97.com only accepts debit and credit cards issued by Mastercard and Visa, and payment by PayPal to sales@stromberg-97.com. Genuine Stromberg dealers may also pay with cheques drawn on UK banks, international bank (wire) transfer and international money order. Checks and money orders drawn on US. banks are discouraged. Dealers should contact us on sales@stromberg-97.com to agree payment method before shipment. Bank details for International bank payments are available on request.
 
All credit and debit card transactions are subject to validation and authorisation by both us and the card issuer, to maintain security and prevent fraud. If you pay by PayPal or with a card payment, you will receive confirmation of your payment via email from PayPal (as our card merchant provider). Receipt of other payments will be confirmed by email or simply by dispatch of the goods. If the issuer of your payment card refuses to authorize payment to us, we will not be liable for any delay or non-delivery.
 
Unless otherwise agreed, the full balance due is payable by an agreed method for all products ordered prior to shipment. Customers in North America should pay for their goods in US dollars. Customers from the UK, EU and other countries should pay in UK pounds sterling (£).
 
Prices shown on this website are full recommended retail prices for parts bought from our dealer network. Prices may appear in different currencies depending on your location. Genuine Stromberg dealers will charge prices in their own local currencies. If you are a Genuine Stromberg dealer, the prices we charge you will reflect the level of discount agreed with you.
 
Sales Tax and VAT
Prices shown on this website are full recommended retail prices, including local sales taxes. No local Sales Tax is payable on orders shipped by Stromberg Carburetor within North America. Our EU (European Union) VAT number is GB930 9394 09. UK and EU customers will be charged Value Added Tax (VAT) at the prevailing UK rate (currently 17.5% - changing to 20% on Jan 04, 2011) on qualifying purchases. If you reside within the EU  but not in the UK, and are a bona fide business who can supply a genuine EU VAT (IVA or equivalent) number, you will not be charged VAT on your shipment provided it leaves the UK direct from us. No VAT is charged to customers from outside the EU, provided the order leaves the UK direct from us. This includes products shipped from our US warehouse to customers in North America.
 
Shipping
We aim for next day turnaround. However, in most cases, your order will be processed and despatched within two (2) working days. Orders will usually be confirmed to you as shipped.
 
The quoted delivery period within which you will receive your order is approximate. Goods will be sent to the address given by you in your order. If you are ordering more than one item, your goods may be sent to you in instalments if certain items are out of stock.
 
You are responsible for all shipping charges unless specifically excluded as set forth below. For all international shipments except North America, all products shall be F.O.B. England, subject to the carrier’s minimum insurance levels. If you require additional insurance, please let us know with your order. You are also responsible for duty and customs clearance charges at the receiving port of entry.
 
Unless shipped direct (in which case the above terms apply), deliveries to customers in North America are shipped from our warehouse in Kentucky (c/o Prime Logistics, 7500 Empire Drive, Florence, KY 42012, USA). In this case, responsibility passes to Genuine Stromberg dealers only once the package leaves Prime Logistics.

We reserve the right to refuse to ship products when we believe the address quoted does not guarantee that products will arrive safely.
 
Shipping & Handling Charges
Shipping and handling charges will depend on the size and weight of the order and the location and will be advised on your invoice before shipment. We ship by the most cost-effective method. In North America, we ship either by USPS, UPS or Fedex ground. To other regions, small packages go by Royal Mail First Class recorded ‘signed for’ or Airmail Small Packet service, while higher value orders go by tracked courier. For international shipments from the UK, we use Fedex International Priority – overnight or 2-day. If you prefer to make your own arrangements, please let us know.
 
International shipments may be subject to cross-border inspections by customs authorities.
 
Please note that occasional orders are shipped from the UK direct to North American addresses if US stocks are temporarily low. In this situation, our systems are designed to settle any import or customs duty or tax on your behalf. In the rare event that you, rather than us, are charged US import duties or fees for US customs clearance, simply email us proof of payment (and the customs paperwork showing that the charges relate to a Stromberg Carburetor parcel) and we will reimburse you. For shipments to other countries, local import duties and taxes will be the responsibility of the buyer.
 
Your right to cancel
If you haven't submitted an order, you may clear the items in your shopping basket at any time by clicking the 'Remove' button next to the product you do not wish to purchase.
 
Once purchase is confirmed, European Union (EU) residents who bought products direct from stromberg-97.com have the right to cancel the whole order within seven (7) working days of receiving it. Just email us at sales@stromberg-97.com to request cancellation. If you have already received the goods, for a full refund (including original shipping to you) you will need to return the entire order at your own cost. After 7 days only an exchange or credit note will be issued.
 
If you live outside the European Union (eg. the USA) you may still cancel your order and return the goods, but your refund will not include the original shipping costs to you.
 
If you bought your Genuine Stromberg Carburetor product from a third party (eg. a Genuine Stromberg dealer), please contact them for details of their own return policies.
 
We will not accept returns (where the item is not faulty but you wish to cancel your order) if the item is not returned in its original packaging and any additional protective packaging which we have supplied.
 
If you are returning a non-faulty item, we will give you a full refund for the item, however, we will not refund the cost of delivery, and you are responsible for paying any return delivery costs.
 
Warranty Returns
Warranty returns must be processed according to our published warranty procedure with an accompanying Warranty Return Tag and RGA number. Please see the Limited Warranty for details. Genuine Stromberg dealers can also download the document (including the Warranty Return Tag) at our Dealer Center. We cannot accept liability with regard to any claim you make where you have not complied with the claims procedures in these conditions
 
Online purchase Return & Exchange policy
We accept returns and exchanges on all items bought direct from stromberg-97.com. If you want to change your product for a different style, size or colour, or if you are not completely satisfied with your purchase, please email us at sales@stromberg-97.com within 7 days of receipt to request a return. We will email you a Returns Form (by pdf file) with a Return Goods Authorisation (RGA) number which must be quoted on the return parcel to us.
 
We ask you to take reasonable care of the goods you purchased while they are in your possession. This means that you may inspect and try on the goods as you would try them on in a store, but tags should not be removed from any item and the original packaging should be retained. Goods should not be soiled, torn or damaged.
 
You can send the item(s) back to us through any postal service of your choice, with the completed Returns Form. Items should, wherever possible, be returned in their original packaging. You should include the Returns Form as it will include the order number it relates to, your details and whether you want a refund or an exchange. Without these details we won't be able to take the action you require. If the new style/size/colour is unavailable, we will email to inform you.
 
The item is your responsibility until it reaches us so, for your own protection, we recommend that you send it certified mail with insurance for the full value of the goods. We cannot refund Return and Exchange items lost in the post.
 
Please allow 10-14 working days from receipt of a return for us to process a refund. Once a refund is processed you will receive a confirmation email (sent to the same email address as your order confirmation). After receiving the return confirmation email, please allow 5-10 working days for the refund to clear into your account. This time frame is dictated by your bank or card issuer.
 
Your refund will be credited to the same card with which you made your original purchase. If for any reason this is not possible, (eg. the card has expired) we will contact you to discuss alternatives.

Please do NOT ship your return parcel from USA back to the UK. If you are returning anything to us from outside the EU you must complete a customs declaration correctly indicating that the package contains 'returned goods'. If your parcel is stopped in UK customs and a charge levied, we will refuse payment and the package will be returned to you. Under no circumstances will we pay customs duty in order to receive back our clothes.
 
Mis-shipped Merchandise Returns
Please inspect orders immediately upon arrival to ensure that you have received the parts ordered and that they are free from shipping damage. If damaged, keep all merchandise and damaged packaging as evidence and file a claim with the carrier. Do not send freight-damaged merchandise back to Stromberg Carburetor or our warehouse..
 
If you believe a product is ordered in error, or mis-shipped, you must contact us immediately at sales@stromberg-97.com and we will advise on how to proceed with the return. We will typically issue an RGA number and an address (UK or USA) for merchandise return. RGA numbers issued to Genuine Stromberg dealers are only valid for thirty (30) days after issue. Unless agreed by Stromberg Carburetor, no returns for items ordered in error will be accepted after thirty (30) days of receipt.
 
All returns must display the valid RGA number on the outside of the package, be returned within thirty (30) days after issue of the RGA number, and freight must be pre-paid. Stromberg Carburetor does not accept CODs.
 
If the return is due to our error, we will credit the return shipping costs (not packing) to your account.
 
If we determine the return is valid, we will evaluate the returned merchandise and determine whether to exchange, credit, or refund the original invoice amount of the merchandise. Original shipping charges are not refundable unless covered under the EU Distance Selling regulations. However, the direct (not packing) shipping costs for the return will be credited to your account. Returned goods must not be used, disfigured, or modified in any way.

We shall be under no obligation to fulfil an order for a product that was advertised at an incorrect price. In the event that you order an item and the price published on stromberg-97.com is incorrect for any reason, we will email you to inform you that we have not accepted your order, and that your order has been cancelled. You will be advised of the correct price of the subject product. You may re-order it if you wish. If you have already paid for the goods in the circumstances described in this clause, we shall refund the full amount within 30 days of the date of order. Should you choose to re-order at the correct price, a separate transaction will be posted to your credit card.
 
In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, we shall make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund to you the amount you paid for the goods in question provided that you notify us of the problem in writing at the address stated in the confirmation email within 7 working days of delivery of the goods plus return the goods to us, unless we inform you that return is not necessary.
